21st Century Schizoid Man middle section. Proggers have noted that for years although I'm not sure if Yes ever copped to it (it seems like a pretty apparent influence/borrowing regardless of whether they admit it or not). |
Decided to check into it. From "Yes Stories: Yes In Their Own Words" by Tim Morse:
"Steve (1992): It was Chris who wrote the main riff. I always thought the riff was influenced by "21st Century Schizoid Man" but I suppose we got away with it." _________________

So, as anyone who's ever listend to the song in headphones or anyone with Wikipedia access knows, "I've Seen All Good People" has a snippit of "Give Peace a Chance" dubbed into the one chorus. I expected them to just omit it from the mix to avoid a licensing issue, but not only did the include it, they charted it to the vocals.
So, anyone think this required extra licensing with Ms. Ono-Lennon? I only ask out of curiosity and to make conversation, not because it makes me wonder if they licensed the entire song for release one day, thereby renewing my hope for another Lennon pack that includes "Instant Karma!". Which -conveniently enough- is a phrase mentioned several times in the same song, further proving that my post is on-topic and not a wishlist… _________________

Wouldn't think so. They are just quoting one line of the song, once. Bad Religion quoted an entire verse of 21st Century Schizoid Man and I don't believe they needed permission for that either. Someone with more knowledge of the legal issues may know more, but I'd think up to a point it would all fall under fair use. _________________

That's true. I guess it's not like they're using a sample or anything. I just thought using the same lyrics in the same vocal melody for something that's intended for sale would require permission at least. Could be wrong though. Guess I'll have to be content with playing the Instant Karma! drum fills on the air drums for the foreseeable future. _________________
