The upgrades only work with the RB3 versions, not the on disc versions, so if you only have the on disc versions, then for all intents and purposes they have no upgrades. |

Exactly. The RB3 versions are, in-game, considered completely separate songs from the on-disc versions.
Ergo, according to the in-game programming, no on-disc songs have upgrades. |

As Maximus pointed out, it was silenced out for Scene because it was repeated so many times (and I believe Harmonix actually showed El Scorcho vs This Ain't a Scene as an example of when RBN authors should consider censoring in the documentation somewhere) |

No, only DLC songs available in the store can receive pro upgrades. This is intentional as to keep people from buying the 1$ pro chart and thinking they got the entire song.
Since those songs were re-released as DLC (two of them appearing playable on Wii as a non-disc song for the first time) they were able to have Pro upgrades available for purchasing. Not only that, but they also have keys and harmony support, so they're completely different songs to the game anyway.
The only way at this point that we get pro upgrades to ANY disc song are:
1) Harmonix releases a massive "pro upgrades pack" that includes upgrades for most RB1/2/Lego/Green Day exports (the six Green Day DLC tracks can actually get upgrades by themselves under the current system)
2) The next Rock Band title includes Protar charts on-disc which are patched into the song data (ala the Pearl Jam tracks getting harmony support when played in RB3) on-load |

I don't think it's possible to get a pro guitar upgrade without owning the song first anyway. I could be wrong, since I haven't tried to, but the option of getting the upgrade isn't available until I first purchase the song itself. _________________
